Copyrighted Works Displayed Without Permission Challenged In Court

You may already know that the photos you post on Instagram are being used without your knowledge or permission by third parties. You may not know that Instagram’s policies require first obtaining permission.

In a case before the 9th Circuit Court of Appeals in 2013, this matter was dismissed because the online publisher only links back to an Instagram image. The user views the image in the original storage location. Photographers Alexis Hunley and Matthew Scott Brauer have decided to file papers to re-consider this line of thought, claiming that things have changed a lot since 2013.

At least two judges in New York—perhaps more—have decided that where the images are stored may not make a difference in unauthorized and unlicensed use of copyrighted material. The next step in the matter, Instagram’s response, is expected over the summer months.
